New Smoke and Carbon Monoxide Detectors Regulations – 1st October 2022

The new Smoke and Carbon Monoxide Detectors regulations will become law on 1st October 2022 in England. There are two major changes landlords need to be aware of:-

 

i. Smoke alarm regulations will now apply to all tenancies. Previously, they only applied to new tenancies created post-October 2015. All tenancies – whenever created – will now need smoke and carbon monoxide alarms where appropriate.

 

ii. Previously, carbon monoxide alarms were only required where a tenant had the ability to burn ‘solid fuel’. Going forward, carbon monoxide detectors will be required in any room where there is a ‘fixed combustion appliance’. In simple terms, this means that oil and gas fired boilers come under the new rules together with gas fires.
